1.APPLICABILITY

These Terms of Use regulate the conditions of use of services offered on the website [www.arthousevienna.at] (henceforth: "website") of the website operator Adrineh Simonian (henceforth: "creator").

The creator makes erotic films of varying quality and lengths (henceforth: "clips") available to users for a fee as an "internet stream".

2. USER OBLIGATIONS

Users guarantee to be of adult age, being 18 years old or older. The use of this website is explicitly forbidden for persons younger than 18 years old.

Users are obliged to use the offered content exclusively for private use. Users are therefore forbidden to use the offered content of the website or the access to this content for commercial purposes; to imitate, sell or rent it, or to use or offer the content for own or other's advertising purposes. This includes that it is forbidden to copy, save, spread or otherwise commercially use the content provided by the creator or third parties.

Users are obliged not to undertake any measures that change or manipulate the website and its content, or undertake any measures that could hinder the functionality of the website, or allow the unauthorised access to third party data, or modify, overwrite, or change in any way content or areas of other users.

Users are obliged not to undertake any action aiming to access any personal data of other users saved on the website or to collect and/or share any personal data of other users without their consent.

3. PURCHASE AND CANCELLATION OF SUBSCRIPTIONS / REGISTRATION PROCESS

To gain access to and view the clips, users must complete the purchase of a subscription for a monthly fee. To this end, users must provide their personal data (including name, address, email address, date of birth and credit card details) and agree to the Terms of Use and the Privacy Policy.

This requested data especially serves the compliance of age restrictions in regards to the Protection of Young Persons Act (for this view the separate privacy policy).

The subscription is priced at € 15,- per month and can be cancelled on the website in the category "My account" by the user at any time without stating reasons. If the subscription is not cancelled, it renews automatically for another month. After cancellation, the subscription remains active until the end of the given month and then finishes. The cancellation must be requested by the user at least 24 hours before the end of the current months in order for the subscription to end with the end of the same month. Otherwise, the cancellation only takes effect at the end of the following month.

A subscription is considered purchased after the arrival of the purchase price in full, after the user has provided their data and there is no doubt that the user is 18 years or older, which is potentially checked on our part. During the entire duration of a purchased subscription, the user has access to all clips on the website as an "internet stream". Downloading clips is not permitted.

Users explicitly agree that the fulfilment of the contract begins before the end of the withdrawal period. Therefore, after the purchase of a subscription withdrawing from this contract is no longer possible. This is a case of exception in line with § 18 Abs 1 Z 11 Fern- und Auswärtsgeschäfte-Gesetz (FAGG).

4. PAYMENT

The subscription payment occurs through the payment service provider "SegPay". Users are offered the following options of payment: credit card and/or PayPal.

5. WARRANTY DISCLAIMER

The creator cannot guarantee that the website services are available at all time without interruption, in full and void of errors.

The creator also cannot guarantee that the hardware and software necessary for the use of website services work correctly at all times.

Further, the creator cannot offer warranty for content that is accessible through links to other websites or services. This includes any announcements, offers and advertisements. Legal transactions performed between users and operators of linked websites only legally affect the user and operators of linked websites.

The creator reserves the right to take clips off the website. This is especially the case when protagonists declare their consent to publish revoked. In this case, users have no right to demand the continued "streaming" of this purchased clip. Users are, however, offered another clip – similar in length and quality – for free or discounted.

6. LIABILITY 

The creator is not liable for damages arising from transmission interruptions, delays, errors, technical malfunctions, loss or deletion of data, viruses or other problems, excluding any damages that were caused deliberately or by way of gross negligence by the creator.

The creator is not liable for actions of users or third parties which violate these Terms of Use or any other illegal action of users or third parties which use the website to spread their content.

The creator is not liable for the content of third party websites that are linked on this website.

7. INTELLECTUAL PROPERTY RIGHTS 

The creator is the owner of all rights of the content offered on this website (including but not limited to copyright, trademark right, patent right, ancillary copyright and licensing rights). In particular, the creator is sole originator of the offered clips, which are published (only) through her.

8. FINAL PROVISIONS

Should individual regulations of these Terms of Use be invalid now or in the future, the remaining Terms of Use remain untouched.

There are no oral collateral agreements. A change in Terms of Use must be undertaken in writing. This also includes the cancellation or alteration of this requirement for changes to be in written form.

Arthouse Vienna does not promote nor condone human trafficking, sex trafficking, physical violence, prostitution or other institutions lacking consent.

9. APPLICABLE LAW / PLACE OF JURISDICTION 

The legal relation between the creator and the users emerging from the website and the use of website services are exclusively subject to Austrian law excluding the conflict-of-law rules of the Austrian IPRG and the UN sales law.

The responsible place of jurisdiction for all disputes emerging from these Terms of Use or the use of website services is the Court of Vienna Inner City.
